NCZ0ft Sues Over TERA

The North American launch of TERA could be threatened by legal action filed by NCZ0ft, which claims that Bluehole stole Lineage 3 software and artwork to use in the game.

TERA is, at the moment at least, slated to open to North American gamers on May 1, but NCZ0ft is looking to put the kibosh on that plan. The MMO giant has filed suit in a New York federal court seeking an injunction against the game, claiming that the former NCZ0ft employees who left the company to found TERA maker Bluehole Studio "made off with copious amounts of confidential and proprietary NCZ0ft information, computer software, hardware and artwork relating to Lineage 3" on the way out the door.

"Their business plan was simple and audacious: create a competing product using the very work they had done while at NCZ0ft, launch it themselves to great fanfare and acclaim, and, in the process, deal a crippling blow to their former employer," NCZ0ft said in the complaint, adding that a Korean criminal court convicted the former employees of stealing trade secrets in 2009. NCZ0ft filed a lawsuit against Bluehole in Korea in 2010 in which it won damages and an injunction against the use of its proprietary information, although the damages award was later overturned; both the civil and criminal cases are now awaiting appeal before Korea's highest court.

The lawsuit covers a lot of ground, ranging from the "secret discussions" held by dissastisfied NCZ0ft employees that resulted in the disclosure of proprietary Lineage 3-related information to third-party investors and the eventual founding of Bluehole, to similarities between various game elements like characters and political systems and even comments from beta testers remarking on the similarities and links between TERA and Lineage 2. The suit claims that Lineage sales and market share have declined in Korea since the launch of TERA and says the same thing "can reasonably be anticipated" in North America if the game is allowed to launch here.

"Bluehole unquestionably used NCZ0ft's copyright and trade secret information to develop TERA. It appears beyond doubt that Bluehole and En Masse [Bluehole's U.S. subdiary] are now also using NCZ0ft's copyrighted and trade secret information in its previews of TERA in the United States and will continue to do so after TERA is commercially released in the United States," the suit says. "These actions are unlawful, cause irreparable harm to NCZ0ft and NCI, and should be remedied pursuant to law."

NCZ0ft is seeking preliminary and permanent injunctions against the launch of TERA in the North America, an order to return all its proprietary stuff and "enhanced" damages due to Bluehole's "knowing and willful misconduct." Bluehole, entirely unsurprisingly, has only said that it does not comment on legal matters.

Well, you can't deny that TERA looks like another NC game (L2, Aion, GW, ...) and when you add up facts (former employees, same genre, same (arguably) gameplay) you get the perfect lawsuit.

On the other hand, they did not interfere with TERA's launch in Korea, which should be their top priority (along with Russia). In NA they don't have much to lose, just a bunch of bots...

well... TERA is created by the same people who did L2 since Prelude until C4 so no wonder it looks like their work :D In my opinion, NCZ0ft still lives from their work and success because with what is NCZ0ft doing now they would be fucked after first 3 months...

L2 is rather old. Also, not everyone is able to tolerate point&click games.

Betrayed ? NCZ0ft betrayed them. As far ive heard, they had since begin of L2 some concept in which this game should be developed...when C4 files leaked, NCZ0ft made pressure on the chief of development to do some things in game which he didnt liked and when he said no regarding implementing shit, he was fired. His team decided to leave with him and NCZ0ft hired idiots who fucked this nice game in all following (from players point of view it was maybe progress but we will never know what was planned with L2 as franchise, if books...playcards..toys..movies...etc) chronicles starting with C5 and followed with Kamael :D But..what wouldnt Koreans do to make grinders more grinding..or ? :D

Oh... Yes, they had even planned Gracia in the beggining. There was a video on YouTube called 'Lineage II - The Forbidden Chronicle' but the account got closed due to copyright violations on other videos. On the video, there was a narrator that said 'discover the flying island of Garcia' (yes, Garcia :P), 'equip cloaks' etc. What we got 2 years ago was planned at the beggining.

So, it's actually NCZ0ft's fault that L2 didn't develop as it should, right?

Considering Tera was suppose to be Lineage 3 ye sure :D.

This is not the first time they get sued. They have been sued in all continents it launched so far too. This is the 3rd iirc , it failed in other will fail here too.

well, upto C5 it was developed by the Old L2 Dev Team.

and since IL and current is by New L2 Dev Team.

you can notice one of the big fails of the New L2 Dev Team, is that the possition of the Primeval Isle in region 20_17 is wrong.

because in the original L2 Complete Map, it was located at the South-East of Heine in region 25_25.

also you can notice others fails, at the possition and design of Kamael Isle also the South of Gracia xD

even with the name of the missing race which is Arteias and not Kamaels.
